General conditions:

The general terms and conditions are drawn up in accordance with the law on consumer protection based on the recommendations of the Romanian Chamber of Commerce and with the international e-commerce codes. The online store of our product (hereinafter referred to as "online store") is managed by CANADIAN FARMACEUTICALS SRL, the provider of e-commerce services (hereinafter referred to as "Seller").

By registering at the online store, the user receives a username that is the same as the email address and password that the user sets. The user name and password define and associate the user with the data entered. By registering, the user guarantees that he is an adult and that he is responsible for his actions.

By registering, the visitor becomes a user and obtains the right to buy. By buying a product, the user becomes a buyer. These 'Terms and Conditions' define the operation of the online store, the rights and obligations of the visitor, user and buyer as well as the relationship between the Seller and the user as a buyer of the products in the online store's offer.

Access to information

The seller is obliged to always make available to the user:

Seller identification data (especially the name and registered office of the company, as well as the unique identification code with which it is registered);
Contact data that allow the user to communicate quickly and efficiently with the Seller (e-mail address, telephone, etc.);
Information on the main features of the products or services purchased in the online store, including after-sales services and warranties;
Information about accessing products and services from the online store's offer;
The manner and terms of delivery of products and execution of services, in particular the place and time of delivery;
Information about the payment method;
Information about the validity of the online store offers;
Information about the period in which it is possible to cancel the offer and the conditions of cancellation;
Information about the return of the goods, and about what can be returned and how much the return costs;
Information about the complaints procedure, respectively the data of the Seller's contact person for communication with users.

Product offer, delivery term and taking orders

The offer of products in the online store, due to the nature of the online business, changes and updates frequently and quickly.
The delivery time of products that are in stock is a maximum of 7 days from order confirmation, sometimes for reasons beyond our control there may be small delays.

For packages weighing more than 2kg, we will contact you to communicate the value of the delivery fee.
The delivery fee on the Romanian territory has the same value regardless of the location.

Payment methods

The seller provides the user with the following payment methods for the products of the online store:
payment on delivery of products, in which case the online price is valid (see point 5.)

Prices

The sale price in the online store are valid for all users of the online store. The prices in the online store are displayed in LEI and contain VAT, unless otherwise specified.

VAT is calculated:

for food supplements and foods 9%
for cosmetics 19%

All prices displayed are the prices of the products and do not include the delivery fee (see points 3. and 10.). All prices are valid for orders placed online.
All prices are valid at the time of placing the order and have not set a deadline, the Seller reserving the right to change prices without notice.

Despite the Seller's enormous efforts to provide the buyer with the latest and most accurate information, the pricing information may be incorrect. In the case described in the previous sentence and in case the price changes during the order processing, the Seller has the following obligations:

To inform the user (buyer) about the new prices, the user (buyer) in this case has the possibility to change his order partially or totally, or to confirm the order with the new prices without additional costs;
To give the user (buyer) access to the order and at the same time must offer a solution for the benefit of both parties.

The buying process

Receiving the order. After receiving the order, the user (buyer) will receive by e-mail from the Seller an order confirmation message. From the receipt of the order confirmation message, the user (buyer) has one hour in which he can cancel the order without consequences. Except for the above cancellation of the order, the user (buyer), after receiving the order, can no longer change the content of the order. The user (buyer) always has available in the online store of the Seller, in his profile, information about the content and status of the order.
Order confirmation. If the user (buyer) does not cancel the order as specified in point 6.1., The order is processed. The seller, after receiving the order, checks the availability of the ordered products and confirms the order or rejects it based on a reason. The seller, in order to verify the accuracy of the data and the confirmation of the delivery address, can contact the user (buyer) by telephone at the telephone number communicated by the user. After confirming the order, the Seller communicates the delivery term to the user (buyer) by e-mail or telephone. The contract for the sale-purchase of the products ordered between the Seller and the user (buyer) is in this final stage (see point 7.).

Freight transport

The seller, within the agreed time, will prepare and send the ordered products, as well as an e-mail notification to the user (buyer). In the notification, the Seller will inform the user (buyer) about the return policy of the products and will provide the contact details of the person.

The right to cancel the order, return the products

The user (buyer) has the right, within 14 calendar days from the receipt of the order, to communicate to the Seller at the e-mail address contact@canadianpharmaceutic.com withdrawal from the sale-purchase contract, without indicating the reason for this decision. The term return of the products purchased from the Seller by withdrawal from the sale-purchase contract is considered cancellation. The only cost that the user (buyer) has to bear as a result of the cancellation is the cost of returning the products.

In any case of return of the products, they must be in the same condition, in the original packaging and box, with the labels intact, UNUSED, and together with all the documents that accompanied it (invoice, warranty certificates, etc.).
Products that show signs of wear or consumption, products customized according to customer requirements, products that show physical changes, blows, shards, scratches, shocks, products without the original packaging or with damaged packaging are not accepted for return.

In order to comply with the withdrawal deadline, it is sufficient to send the withdrawal communication before the expiry of the withdrawal period. The withdrawal period will expire 14 days after:

the date of delivery, ie the date on which you or a third party (other than the carrier) indicated by you, enter into physical possession of the product; or
in the case of several products that are part of a single order and delivered separately: (i) the last day on which you, or a third party (other than the carrier) indicated by you, take physical possession of the last product, or ( ii) if applicable, the date on which we announce that we can no longer deliver the ordered products; or
in the case of an order for the delivery of a product consisting of several lots or parts: (i) the date on which you or a third party (other than the carrier) indicated by you, take physical possession of the last lot or part, or (ii) the date on which we notify you that we cannot deliver additional lots or parts.

In order to exercise your right of withdrawal, you must inform us of your decision using the withdrawal form, which will be sent to you. After analyzing the withdrawal option, we will send you by e-mail the solution of the withdrawal request. Any withdrawal request received will be analyzed and resolved according to the applicable legal provisions depending on the type of products that are the subject of it.

Please note that food and cosmetics sold through the website, which are likely to deteriorate or expire quickly or cannot be returned for health protection or hygiene reasons and which have been unsealed by the consumer are exempt from to the right of withdrawal, according to the provisions of art. 16, lit. d and e from GEO 34/2014, updated.

In order to comply with the withdrawal deadline, it is sufficient to send the communication on the exercise of the right of withdrawal before the expiration of the withdrawal period.

If the withdrawal request is confirmed by us, we will refund the amount related to the products that are the subject of the withdrawal request we received from you, except for delivery costs no later than 14 calendar days from the date we are inform you of your decision to withdraw from this contract. We will make the refund by bank transfer, so in the return form you will need to fill in the bank account details.
The costs related to the return of the product / products that are the subject of the withdrawal request will be fully borne by you.

We reserve the right to defer the refund of the value of the products until the date on which we receive the products back or until the moment when you have provided us with proof that you have returned the products, the nearest valid date being valid.

The buyer has the right to opt only once for the return or replacement of a product. Repeated purchase will be considered abuse and the Seller has the right to block with immediate effect, temporarily or permanently, access to the account involved in abuse.

The seller will deliver to the user (buyer) the ordered products within the agreed term. The Seller's contractual partners are the courier companies Fan Courier, DPD, GLS, UPS, TNT. The seller reserves the right to choose another delivery service, if with its help it provides more efficient services.
In case of purchasing products with mail delivery, the user bears the postage costs.

Security

Our product website uses security measures against the loss, alteration or misuse of information under the control of the Company. In case of loss of information caused by "bugs" or errors of the software with which the website is designed and hosted, the company does not assume any responsibility.

Responsibility

The seller, through all efforts, will try to ensure accurate and up-to-date information in the online store, but product properties, delivery dates or prices can change so quickly that the seller fails to correct the information published in the online store in a timely manner. In this case, the Seller informs the user (buyer) about the changes and allows him to cancel or modify the order (see point 5.).

Although the Seller tries to provide exact images of the products sold in the online store, it is recommended that the images be treated as symbolic. Photos do not guarantee the properties of the products.

The seller, from the moment of delivering the package with the products ordered to the courier company, is no longer responsible for the physical damages, the destruction or loss of the package, the lack of the package, or if the package shows signs of opening. In these cases, the user (buyer) must file a complaint with the courier company. If the package is damaged, the user must return the package to the courier at the stage in which it was received, without adding or removing anything from the package, and complete a complaint. The seller, together with the courier company, will ensure the resolution of the complaint as soon as possible.

Complaints, litigation and enforcement

The seller complies with the legislation in force regarding consumer protection. The seller has established an efficient system for resolving complaints and a dedicated person, who, in case of problems, the user (buyer) can contact by phone or e-mail. In such cases, the user (buyer) can ask for help at the phone number: The user (buyer) can send complaints to the e-mail address contact@canadianpharmaceutic.com. The complaints procedure is confidential.

The seller, within 5 working days will confirm the receipt of the complaint and will communicate to the user (buyer) how long the procedure will take and will communicate in time the stage of the procedure. The seller will do his best to resolve any dispute amicably. If no amicable settlement is reached, any dispute shall arise

Seller and user (buyer) will be resolved by the competent courts in Romania. The seller and the user (buyer) mutually recognize the validity of the electronic communication (by e-mail) in court.
These Terms and Conditions and any dispute between the Seller and the user (buyer) are subject to Romanian procedural laws, and are not subject to the rules of private international law.
For all cases, as well as rights and obligations that are not included in these Terms and Conditions, the Law of Obligations, the Law of electronic commerce, the Law of personal data protection and the Law on consumer protection will apply.

Changes to the Terms and Conditions

The Seller, in case of modification of the regulation establishing the operation of online stores, data security and other areas that are related to the operation of the Seller's online store, and in case of change of its business policies, may change and / or complete these Terms and Conditions, and will inform users accordingly.

Each modification and / or completion of these Terms and Conditions enters into force and applies eight days after the publication of the amendments and / or completions. If changes and / or additions to the Terms and Conditions are necessary
